VII. Management of the HSCL

The Faculty Chair

The Vice Provost for Research and Graduate Studies and the Director of Research Integrity select and appoint the Chair of this IRB (HSCL). The Chair must be a regular KU faculty member, and serves at the pleasure of the Vice Provost for Research and Graduate Studies and the Director of Research Integrity. The Chair serves for a renewable three-year term, conducts the monthly meetings of the HSCL, develops HSCL policy in collaboration with the board, delegates to the HSCL Coordinator review of human subjects research projects that meet the criteria for "Exempt Status" and "Expedited Review." The Chair, as do all HSCL members, recuses himself from consideration and voting on projects in which he has a research role.

HSCL members

HSCL members are recruited by the HSCL Coordinator and the HSCL Chair and serve for a three-year renewable term. HSCL membership is staggered so that the board always has more experienced members serving to advise newer members. Board members are expected to attend once-monthly meetings and provide written documentation of their review of assigned research project applications. Board members may be asked to resign if they are unable or unwilling to meet their attendance and project application review responsibilities.

Training of HSCL chair and members

The HSCL Coordinator updates the Chair and members on developments in human subjects research and regulations. New members receive a copy of the Instructions for Submitting Applications to HSCL, a copy of KU's Federalwide Assurance, and a copy of 45 CFR 46, Protection of Human Subject. Board members have also been furnished with a copy of an OHRP produced CD, Research 101.

Board members and researchers occasionally inform the Coordinator of developments in their field of research, which the Coordinator shares with other board members. Members are also invited to attend conferences. In order to assist new members to understand the review process, the HSCL Coordinator also provides sample applications and a suggested model to use when reviewing applications to facilitate new members' familiarization with the review process.

Compensation of HSCL members

HSCL board members receive no monetary compensation; however, the University of Kansas, through its various schools and departments gives University of Kansas HSCL board members credit for service. The amount of credit varies according to department. The university provides the Chair with a one-half time research assistant to compensate him for time devoted to HSCL business.

Liability coverage for HSCL members

The Kansas Tort Claims Act, found at K.S.A. 75-6101 et seq., provides for the defense of governmental employees for acts or omissions within the scope of their employment. For the Kansas Tort Claims Act, K.S.A. 75-6102, in pertinent part, defines "employee" as "any officer, employee, servant or member of a board, commission, committee, division, department, branch or council of a governmental entity in any official capacity, whether with or without compensation." The request for legal representation is to be made to the attorney general, who appoints the attorneys, which may be attorneys from the KU general counsel's office.

Use of consultants

The HSCL Coordinator requests opinion and input from specialists in situations where particular knowledge is required, such as medical questions (if HSCL physician members are not available), education questions, etc. HSCL also seeks input from other IRBs who may have had experience in issues or areas new to HSCL, such as electronic communications for applications, computer-assisted training, etc.

Secretarial/administrative support staff (duties)

The HSCL Coordinator serves as the point of contact for queries regarding new and existing research projects, reviews and approves Exempt and Expedited project applications, maintains a hard copy and electronic database, and is responsible for the day-to-day operation of HSCL.

The University of Kansas provides the HSCL Coordinator with the services of a one-half time student employee in addition to the Associate Coordinator and the Assistant Coordinator. The Associate and Assistant Coordinator attend the monthly meetings. The Associate Coordinator reviews and recommends action on Exempt and Expedited project applications, and serves as the point of contact in the absence of the HSCL Coordinator. This employee also attends some conferences and training sessions offered to faculty and students at the university.

Resources (for example, meeting area, filing space, reproduction equipment, computers)

HSCL is housed in the KU Center for Research, Youngberg Hall, on the West Campus of the University of Kansas, Lawrence. The Coordinator has an office with file cabinets, a computer, and adequate space for storing records and other correspondence.
